Terms of Service

1. Who we are, and what this covers

Marquezee is a service of H-Star Advisors ("we", "us"). These terms cover the Marquezee service: the move of your website, its hosting, the changes you make to it through Claude, and your account at the Marquezee customer panel. They apply from the moment you create an account. If you are signing up for a business, you confirm you are allowed to agree on its behalf.

Our Privacy Notice says what information we keep and why. It is part of this agreement.

2. Your account

• You sign in with a one time code or link sent to your email, or with Google or Microsoft. There is no password. Keep your email account secure, because whoever can read it can sign in as you.
• You can add people to your business with a role: an owner can do everything, an editor can change and publish, a contributor can propose changes for an owner or editor to publish. You are responsible for the people you add and for what they do until you remove them.
• Each person may connect their own Claude account to Marquezee. Connecting it lets that Claude read your site's pages, propose changes, publish when an owner or editor says so, and send us a help request. It cannot reach another business, your domain, your email or your billing. You can disconnect it at any time.
• Tell us straight away if you think someone has access who should not.

3. What we do

The move

We read your current website, build a new one from its content (your words, your pictures, your colors), show you a preview, and switch it over to your domain when you say so. Every old address on your site is kept working, by page or by redirect. Your old site stays up for two weeks after the switch. We never touch the email records on your domain during a move. If you have no website yet, we build from the answers you give us.

You approve the preview before anything goes live on your domain. Until you do, the new site is private.

Hosting and changes

After the move, your monthly plan covers: hosting on an encrypted connection, security, backups and daily health checks; unlimited changes to your content (hours, menu, prices, specials, events, photos, your story and contact details) through the service; accessibility checks every time the site changes; and a person at H-Star to ask.

Design changes, new pages, and changes to your domain or email are not part of your content. They are done by a person at H-Star and quoted separately before any work starts. You are never charged for them without agreeing to a quote first.

How a change goes live

You tell your Claude what to change. It makes the change and sends you a preview. Nothing goes live until an owner or editor says publish. A change that would break the site cannot be published, and the site you have stays up. Every version is kept, so a published change can be undone.

Claude does not invent facts about your business. When something is unclear it asks. What you tell it to publish is your decision, and you are responsible for the content of your site.

4. What you need

• Your own Claude account, on a paid plan, in your name. Claude is a product of Anthropic and your use of it is under your own agreement with Anthropic. Anthropic bills you for it directly. Marquezee is an independent service and is not affiliated with Anthropic.
• A domain you control, or the wish to get one. Your domain stays registered in your name with your registrar. We never take custody of it, and we only point it at your new site with you.

5. Prices and payment

• The prices are the ones on the pricing page when you sign up. Onboarding is charged once, before the move starts. The monthly price is charged in advance each month from the day your site goes live on your domain, or from the day you tell us to start hosting it, whichever is first.
• Payment is by card through Stripe. Card details go to Stripe and never reach us.
• Founding 50. The first fifty businesses pay nothing for onboarding and $50 a month. That price does not go up for as long as you keep your plan. A founding place belongs to one business and one location and cannot be transferred. If you cancel, the place is gone.
• Standard. $499 for onboarding, once, and $199 a month for one business at one location. More locations are priced per location.
• Developers and agencies. For people who look after websites for other businesses: $99 a site a month, no onboarding fee, and a minimum of three sites. The minimum is billed from the start, whether or not all three sites are live yet. The agency is our customer for every site on its account and is responsible for its clients' content.
• We can change the standard prices with thirty days' notice by email. A change never applies to a founding price.
• If a payment fails we tell you and try again. If it is still unpaid after fourteen days we can pause your site until it is paid. Your content is kept while it is paused.
• Prices are in US dollars and do not include any sales tax that applies to you.

6. Your content

• Your content stays yours: your words, your pictures, your menu, your name and marks. You give us the right to copy, store, adapt, serve and back it up as far as we need to in order to move, build, host and change your site. That right ends when your account ends, apart from copies in backups that are deleted in the normal course.
• You confirm that you have the right to use everything you give us and that it is accurate and lawful. Photographs, logos and text you did not make need the permission of whoever did.
• We may decline to publish, or take down, content that is unlawful, that infringes someone else's rights, or that would put the service at risk. We tell you when we do.

7. The site we build

• The design and the code of your new site are ours, made for you. While you are a customer you may use them on your site, and only there.
• If you leave, we send you a full copy of your site's files, and you may use that copy anywhere, for your own business, for as long as you like. What you may not do is sell the design or the code to others, or use them to run a competing service.
• Parts of the site are made with Claude. When we design it, your site's public pages and pictures are sent to Anthropic's Claude to write the design, under Anthropic's commercial terms, which do not allow training on them.

8. Keeping the site up

We do our best to keep your site up all the time, and the hosting we use serves it from a worldwide network. Every version of your site is kept and backed up. We cannot promise the site will never be unavailable: the internet, our providers and planned maintenance can interrupt it. If it is down because of something on our side, we fix it as our first priority.

9. What you agree not to do

• Use your site or the service for anything unlawful, or to publish content that is deceptive, harmful or infringes someone's rights.
• Try to get into another business's site or account, or to reach parts of the service that are not yours.
• Use the connector, or any part of the service, to send spam, run automated abuse, or overload it.
• Resell the service or a site we built, other than under the developer and agency plan.

10. Ending the agreement

• By you. Cancel at any time from your account, or by asking us. Your plan ends at the end of the month you have paid for, and your site stays up until then. Onboarding fees are not refunded once the move has started.
• By us. We can end your plan with thirty days' notice by email. We can end it at once if you break these terms in a serious way, or if a payment is more than thirty days overdue after we have told you.
• What happens then. Your domain is yours and stays where it is; we point it away from our hosting only when you say. Ask, and we send you a full copy of your site's files and your account's data. We delete your account and your data when you say so, and in any case within ninety days of the end of your plan.

11. Our responsibility to you

• We provide the service with reasonable care and skill. Beyond what these terms say, the service is provided as it is, and we make no other promises about it, including that it will suit a particular purpose or be free of every fault.
• We are not responsible for your Claude account, for Anthropic's services, for your domain registrar, or for services your site links to or embeds, such as reservations or ordering.
• We are not responsible for content you or your team publish, or for a loss that comes from a change you asked for and approved.
• Our total responsibility to you for anything arising from this agreement is limited to the amount you paid us in the twelve months before the claim. We are not responsible for lost profits, lost business or indirect losses.
• Nothing in these terms limits a responsibility that the law does not let us limit.

12. Changes to these terms

We can change these terms. If a change matters to you we email the owners of your business at least thirty days before it takes effect. If you do not agree with a change you can cancel before it takes effect and the old terms apply until then.

13. The law, and talking first

If something goes wrong, tell us first at hello@hstarcap.com and we will try to put it right. These terms are governed by the laws of the State of California, and any dispute we cannot settle between us goes to the courts of San Diego County, California.
